The UPC has now been open for more than two and a half years. During this time, the Court of Appeal has started to build reliable case law across key areas – including claim interpretation, inventive step and the meaning of imminent infringement – as it hears an increasing number of appeals.
This first volume provides an overview of the substantive Court of Appeal decisions on infringement and revocation cases, as well as applications for preliminary injunctions. It also highlights two notable appellate decisions concerning the broad scope of the UPC’s jurisdiction.
We will be releasing “Key Decisions of the UPC Court of Appeal 2023-2025: Volume 2” soon. The volume will summarise significant procedural rulings issued by the UPC Court of Appeal from its opening to the end of 2025. It will include decisions relating to confidentiality measures, preservation of evidence, applications for suspensive effect, and the role and responsibilities of representatives before the UPC.
